Dear Mr ....,

Thank you for your phone call to the Department for Environment, Food and Rural Affairs (Defra) about Swedish Snus. Your query has been passed to the Department of Health and I have been asked to reply.

You asked whether you would be able to have Swedish Snus sent to you in the UK by post. The Tobacco for Oral Use (Safety) Regulations 1992 state in regulation 2 that no person shall supply, offer to supply, agree to supply, expose for supply or possess for supply any tobacco for oral use. As the regulations relate to the supply rather than the use of oral tobacco, it would be acceptable for someone to buy snus in Sweden to use in the UK, or to write to a company in Sweden to ask for snus to be mailed to the UK for them to use. A problem might arise if a Swedish company was to send mailings to a person living in the UK to ask them to buy snus as the agreement to supply may then be considered to be happening in the UK. As long as the supply is outside the UK the use of snus will not be a breach of UK law.

I hope this reply is helpful.

Yours sincerely,

Victoria Lindsay
